The receiving facility's operating permit is arguably the most scrutinized document in your notification package. Inadequate facility authorization is the leading technical reason for notification rejection. Importing competent authorities must verify that the facility is legally authorized to receive and process the specific waste types under the exact operations declared in your notification. Understanding what constitutes adequate facility authorization and how to document it properly is essential for approval.
Why Facility Permits Matter
COMPETENT AUTHORITY VERIFICATION:
- Importing authority cannot approve notification without confirming facility authorization
- Facility must be permitted for specific Basel waste codes (Y49, A1181, etc.)
- Permit must authorize specific operations (R-codes or D-codes) matching notification
- Facility capacity must be adequate for proposed shipment quantities
- Permit must be currently valid with adequate remaining term
ESM DEMONSTRATION:
- Valid permit indicates facility meets national environmental standards
- Permit conditions specify environmental protection requirements

Types of Required Permits
HAZARDOUS WASTE OPERATING PERMIT:
- Primary authorization for hazardous waste management facilities
- Issued by national environmental agency or equivalent
- Specifies authorized waste types (by national codes and Basel codes)
- Lists authorized operations (storage, treatment, recovery, disposal)
- Includes capacity limits (annual tonnage, storage volume)

IMPORT-SPECIFIC AUTHORIZATION:
- Some countries require separate import permit beyond operating permit

FACILITY REGISTRATION OR LICENSE:

BASEL-SPECIFIC AUTHORIZATION:

Essential Permit Elements
WASTE CODE AUTHORIZATION:

CAPACITY LIMITS:
- Annual processing capacity (metric tons per year)
- Storage capacity (volume and tonnage)
- Maximum accumulation time before processing
- Notification quantity cannot exceed facility's authorized capacity
- Consider facility's current utilization—may not have full capacity available
PERMIT VALIDITY PERIOD:
- Issue date and expiration date clearly stated
- Must be currently valid at time of notification submission
- Should remain valid throughout notification validity period (12 months typical)
- Most competent authorities require 6-12 months remaining validity
- Expiring permits trigger rejection or conditional consent pending renewal
PERMIT CONDITIONS:
